Federal Court Orders Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. After his return to the United States to answer human smuggling charges, he was detained in federal detention.
In her order, the court noted that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "for now."
